Terms of Service
#1. The service. Nicest lets you view, buy, sell and bid on Tokens that represent physical collectibles held in custody, and take delivery of them. We provide a venue and custody services. We do not advise on value or manage items to increase their value.
#2. Eligibility. You must be 18 or over and not located in, or resident of, a restricted country (currently: United States, Cuba, Iran, North Korea, Syria, Russia, Belarus, and the Crimea, Donetsk and Luhansk regions). Identity checks apply above $10,000 of trading in any 30 days, before every delivery, and in other cases where the law requires.
#3. Your account and wallet. You sign in with an email address or with your own wallet. Buying, bidding, selling and holding Tokens require a wallet you control, which you connect to your account; we don't create or hold wallets for you. You are responsible for your wallet and sign-in details. We never hold your Tokens or funds except while a bid is escrowed in the Marketplace contract or an item is held for delivery.
#4. Primary sales. When we sell a Token from our own collection, we are the seller and title passes to you under the Token Terms. Where another user sells, we act only as the venue.
#5. Asking prices and bids. Holders may set an asking price for a set period. Anyone may place a bid on any item, with or without an asking price. Bids are funded in full when placed, held in the Marketplace contract, cannot be cancelled for 24 hours, and otherwise stay open until accepted, cancelled or expired. Accepting a bid, or buying at the asking price, completes the sale immediately.
#6. Fees. The trading fee is 3% of the higher of the sale price and the item's PAV, paid by the seller. Every action shows its fees before you confirm. Network fees may apply when you use your own wallet.
#7. Pricing data. Bids, sales and price history are public and may be used by us and shared as market data. Personal data is excluded.
#8. Prohibited conduct. No wash trading, spoofed bids, collusive pricing, manipulation of reference prices, sanctions evasion or money laundering. We may cancel orders in our interface, restrict accounts and report to authorities.
#9. Community. Clubs, events, Discord and points are provided as they are. Points have no cash value, cannot be transferred, and do not entitle you to any token, payment or other asset. We may change or end the points programme at any time. Be respectful; we may remove content or access for abuse.
#10. Invites. You can invite others to Nicest with your invite link. Invite rewards are paused: inviting someone earns no rebate, fee refund or points. If we start a reward programme, we will set out its rules here and ask you to accept them first.
#11. Taxes. You are responsible for your own taxes. Import taxes and duties on delivery are payable by you.
#12. Risks. Read our risk summary. Collectible values can fall as well as rise.
#13. Availability and changes. We may change or suspend the service, and update these Terms with 30 days' notice. Changes cannot reduce a Holder's ownership rights under the Token Terms.
#14. Liability. Nothing limits liability for death or personal injury caused by negligence, fraud, or anything that cannot be limited by law. Otherwise our total liability to you is limited to [the fees you paid in the previous 12 months / £X], and we are not liable for losses caused by blockchain networks, wallets or third-party services we don't control.
#15. Law. England and Wales. If you are a consumer living elsewhere in the UK you may also bring claims in your local courts.
